Back in May of 2012, young Keanu Becker, 12, was riding his bicycle when he was hit and thrown from his bicycle by a driver, Ms. Triplett, who claimed the sun was in her eyes. He was riding his bicycle on 108th Lane in Levy County when hit from behind and shoved onto the shoulder of the roadway, according to a Florida Highway Patrol report. Tragically, the victim suffered fatal injuries.

On December 10, 2012, Ms. Triplett pled no contest to, and was adjudicated guilty by the County Court, Hon. James T. Browning, for violation of Florida Statute 316.183–unlawful speed/failing to use reasonable care causing the death of a human being. Cpl. Yuncker, of the FHP, provided a factual basis to support the plea in stating that Ms. Triplett said in a sworn statement the sun was in her eyes at the crest of a hill prior to striking the bicyclist. However, measurements indicated over 200 feet of stopping distance between the crest and the point of impact. Cpl. Yuncker indicated she believed the charge was appropriate because the statutory language created a driver’s obligation to maintain reasonable speed under the circumstances.

The Court imposed penalties which included an automatic 6 months Driver’s License suspension, a $1,000.00 fine, $98.00 in Court Costs; and a 12 Hour Driving Class.
