Ocala Woman Injured in Scooter Accident

By / 0 Comments /

The  Scooter & Moped Accident Attorneys of the Law Office of Alba & Yochim P.A. take note of the alarming number of accidents involving vulnerable road users, that have occurred in recent years in Gainesville, Ocala, and surrounding cities in Florida. As personal injury and wrongful death attorneys, we have witnessed the devastation that occur as a result of a collision between a vulnerable road user and an automobile.

We previously discussed an incident in which a motorist rear-ended a moped, killing the driver, and critically injuring the passenger. It is important that motorists remain aware of the presence of road users that lack the protection afforded by a vehicle, and take the precautions necessary to ensure their safety. Consider the following scooter accident, as discussed according to facts provided by the Gainesville Sun:

An 86-year-old Ocala woman was injured after being struck by an SUV while riding her motorized scooter. According to FHP, the incident occurred on Thursday, February 20, 2014, near State Road 200, at Southwest 86th Circle.

Apparently, Elaine Harrington, 86, of Ocala, was operating her motorized scooter across an unmarked crosswalk by the entrance/exit of a shopping plaza. At the same time, Gwen Robertson, 73, of Michigan, was exiting the shopping plaza in a 2008 Lincoln Navigator SUV. Robertson, who failed to observe Harrington, struck the victim and her scooter, with her SUV.

Although the driver of the SUV was not injured in the incident, the driver of the scooter, being a vulnerable road user, was not so lucky. Harrington was transported to Ocala Regional Medical Center for injuries sustained as a result of the collision. Fortunately, her injuries were not life-threatening.

This accident demonstrates the dangers that vulnerable users face as they travel along roadways shared with motor vehicles. Vulnerable road users include the operators of motorized vehicles, such as motorcycles, mopeds and scooters. However, vulnerable road users also include other persons that are more susceptible to catastrophic injury or fatality in collisions with a motor vehicles, such as bicyclists and pedestrians.

If an injury or fatality occurred while the victim was traveling via scooter, moped, motorcycle, bicycle, or on foot, compensation may be available. In addition to PIP benefits, which are available depending on the classification of the vehicle involved, victims may also be able to recover from the bodily injury coverage of the negligent party’s auto insurance, or in some cases, from the victim’s own policy, under their UM/UIM coverage.
