Gainesville Church Volunteer Arrested on Felony Charges for Sexual Battery of Toddler

A large portion of our personal injury blogs address injuries and fatalities extending from accidents. However, as Child Sexual Abuse Attorneys, we also will occasionally discuss incidents of sexual abuse that occur amongst our communities. Although any sexual abuse involving a child is appalling, we take note of the recent arrest of a Gainesville man, which we find particularly disturbing given the age of the victim, as well as the location of the alleged abuse.

According to authorities, on April 2, 2014, 64-year-old Floyd Delmer Wilson, of 2702 SW 13th Street, was taken into custody on charges extending from allegations of sexual battery on a 2-year-old child occurring during Wilson’s volunteerism as a baby-sitter at Parkview Baptist Church.

As stated in the police report, the toddler’s mother was bathing the young girl on the evening of Monday, March 31, 2014, when she observed that the child’s genital area appeared to be swollen. The toddler told her mother that she “hurt there,” and also said that a teacher had touched her. Thereafter, the child re-enacted the touching on a doll, thereby causing the mother to contact the Gainesville Police Department.

The following day, the Gainesville Child Protection Team examined the girl, where they were able to confirm that the child did have irritation from an unidentified cause. The toddler also told investigators that the alleged perpetrator had touched her underneath her clothing.

Upon interview, the accused initially reported that he had picked up the girl on Monday and did inadvertently touch her. However, he later admitted to a Gainesville officials that he had reached inside the girl’s pants and ‘accidentally’ penetrated her while attempting to lift the child over a ledge. According to the report, authorities say that Wilson was ‘smiling’ as he discussed the event with police.

Notably, Wilson’s response to whether he had touched any of the other children that he was exposed to while a church volunteer, ranging in age from 6 to 16 years-old. Rather than definitively answering the question in the positive or negative, the accused would only say “I can’t remember,” “I don’t believe so,” or “not to my knowledge.”

In addition to statements from the child, the child’s mother, and the accused, a statement was also taken by a witness that was present at the time of the alleged incident. According to the witness, the child was observed “hysterically crying,” in the presence of the alleged perpetrator.
