Fatal Stabbing in Hospital Garage

The attorneys of the Law Office of Alba & Yochim P.A., as well as members of our community, continue to mourn following the murder of Casey Renee Wilsey, 37, of Bronson, in a parking garage at North Florida Regional Medical Center in Gainesville on January 13, 2014.

The incident occurred as the victim, who worked in the complex, arrived at work and parked her vehicle on the third floor near the entrance for the Women’s Center. Investigators say that the victim’s estranged husband, Walker Gage Wilsey Sr., a registered sex offender, attacked the victim while she was still inside of her vehicle, after waiting for the victim’s arrival at work. As a result of the attack, Casey Renee Wilsey suffered a fatal wound to her torso, and was pronounced dead at the scene.

During the initial investigation, and with information provided from the victim’s family members, officials were able to quickly identify Walker Wilsey as the most likely suspect in the murder. As Gainesville Police Department searched for Wilsey’s whereabouts, they discovered that Wilsey had been found dead in a Daytona Beach home, apparently due to self-inflicted wounds to his neck and throat.

Our sincerest sympathies go out to the grieving family members and loved ones of the victim in this tragic incident.

While we understand that nothing can ever replace the loss of Casey Renee Wilsey, as legal professionals serving the members of our community, we are drawn to the various legal issues presented by this horrific event.

As Domestic Violence & Abuse attorneys, we take note of the domestic nature of this tragic incident. According to Levy County court records, in November of 2013, a temporary restraining order was granted to the victim, and was subsequently extended. Unfortunately, the victim’s demise prevented her attendance at the domestic violence hearing, which had previously been scheduled to take place on February 20, 2014.

In addition, as premises liability and wrongful death attorneys, the Law Office of Alba & Yochim P.A. also takes note of the location of the murder, which occurred in a parking garage that offers free parking 24 hours a day. While the hospital’s website does state that a Visitor Management System is in place for security purposes within the hospital, it is unclear as to the extent of security offered to individuals that park in the garage.

An important consideration in assessing potential liability, is whether the person or entity having ownership or control of the garage, presumably the hospital, knew or had reason to know of any foreseeable dangers that may result in harm to persons lawfully occupying the property. Establishing the presence of a known or foreseeable danger in premises liability actions can include evidence demonstrating prior instances of criminal conduct on the property where an injury or fatality occurred, or awareness of valid safety concerns associated with high crime rates in the general vicinity.
