ATV Collision Kills One, Critically Injures Another

As ATV Accident Attorneys, the tragic accident involving the fatality of one victim, and the critical injury of another, serves as a reminder to to the Law Office of Alba & Yochim P.A. and the members of our communities, of the dangers associated with the use of all-terrain-vehicles.  ATV accidents, which are on the rise, can be highly devastating. In fact, there has been a notable increase of ATV-related injuries and deaths over the past two decades throughout our nation. For the residents of Florida, what is most disturbing, is that a 26-year-nationwide study by cpsc.gov revealed that our state is ranked within the top-five states for ATV fatalities.

This unfortunate Seminole County accident occurred shortly after 9 p.m. on Friday, March 28, 2014, at East 1st Street and Avenue C in Chuluota. Authorities say that the driver of the ATV lost control, and thereafter collided with a pole at the end of the street, causing both victims to be thrown into a wooded area.  Tragically, 22-year-old Daniel Huffman, of Oveido, suffered fatal injuries, and was pronounced dead at the accident scene. According to officials, Wayne Badertcher, 23, of Chuluota, however, survived the incident, but sustained catastrophic injury, and had to be air-lifted to the hospital in critical condition.

Residents say that prior to the collision, a neighbor had requested the victims to slow down, due to concerns that their reckless ATV driving might cause injury to children in the neighborhood. Apparently, the two passengers on the ATV were observed traveling at a speed, estimated by residents, to be somewhere between 40 to 50 mph.  Authorities report that they are investigating the matter, to determine whether drugs or alcohol played a role in the collision.

Neighbors additionally provided to news reporters that, although the use of an ATV is not uncommon in the wooded areas of the community, the use of such vehicle is highly discouraged upon residential roads, due to the presence of children that reside in the area.
