Alachua County Sheriffs Arrest Dallas Brass Drummer for Sex Crimes against Teen

The Child Sexual Abuse Attorneys of the Law Office of Alba & Yochim P.A. comment on a series of events involving the victimization of a Gainesville teen.

Officials arrested 28-year-old Ryan Burd early Wednesday morning on several felony charges, extending from Burd’s attempt to meet with a 14-year-old High Springs girl, on two separate occasions, with the intention of engaging in sexual intercourse with the teen. According to his Facebook page, Burd, has been employed as a Percussion Caption Head at Troopers Drum & Bugle Corp since 2012, and as a drummer and percussionist for Dallas Brass since 2013. Apparently, Burd and the teen met a fundraising event, held at Westside Baptist Church in Gainesville on Saturday, where Dallas Brass performed and led a music clinic for students.

The victim told authorities that sometime following the concert, she “liked” the Facebook page for Dallas Brass, and then was able to find Burd’s personal Facebook page. Thereafter, the two began communicating through Facebook. According to officials, Burd inquired about the teen’s age, at which point she revealed that she was only 14. Despite knowing her minor status, Burd continued to communicate with the teen, while also making statements implying that he wanted to have sex with the teen.

Burd, a resident of South Carolina, remained in Florida, due to concerts that were scheduled for Tuesday and Wednesday in Ocala and Clearwater. According to the victim, sometime between Sunday, February 16th at 11 p.m. and Monday February 17th at 5:15 a.m., Burd traveled to the teen’s home in High Springs, parked down the street, and the teen, without her parent’s knowledge, allowed the accused to enter.

The victim reported that after refusing to have sex with Burd, who had brought a ‘towel for having sex,’, Burn then kissed the teen, before being asked to leave. According to the report, Burd did leave the victim’s home, but was also able to obtain the victim’s cell phone number. Following this incident, the victim reported the incident to Alachua County Sheriff’s Office.

As officials were investigating the incident, Burd apparently contacted the victim and apologized for the events that had transpired during the initial encounter. Thereafter, officials sent a message to Burd through the teen’s Facebook page, which he responded to by offering to drive to the victim’s home again on Tuesday, following his scheduled performance in Ocala. When Burd arrived at the victim’s home at approximately 2:30 a.m. on Wednesday, Alachua County Officials arrested Burd, who had again brought with him, a ‘towel for having sex.’

Following his arrest, Burd admitted to authorities that although he intended to have sex with the victim, even though he knew she was only 14 years old. Officials charged Burd with three felony counts of traveling to lure a child, use of a computer to seduce a child, and use of a two-way communication device to commit a felony. Burd was taken to Alachua County Jail, with his bond amount currently set at $100,000.

It is important to know, that in addition to seeking criminal liability against the perpetrator of a sex crime, the victim and/or their family, also has the additional remedy of asserting a civil action for damages extending from the abuse. While a civil action against the actual perpetrator is one option, such efforts may prove to be fruitless in cases where the accused/convicted is incarcerated, and/or otherwise financially incapable of providing compensation.

However, often times the circumstances of the abuse are such that another person or entity can be held liable for their negligent actions or omissions. In some cases, such as where the evidence supports a finding of gross negligence, punitive damages may also be awarded.
